Terms of Service

1. Acceptance of Terms

By accessing or using the DealHarbor platform ("Service"), available at dealharbor.app, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

These Terms constitute a legally binding agreement between you and Faisal Khan LLC ("Company," "we," "us," or "our"), the operator of DealHarbor.

2. Description of Service

DealHarbor is a two-sided marketplace connecting individuals and businesses seeking financial services (including banking, licensing, payments, compliance, crypto, FX, and trade finance) with vetted solution providers. The platform facilitates introductions and proposal submissions but does not itself provide financial services.

DealHarbor acts as a marketplace intermediary. We do not guarantee the quality, suitability, or outcome of any engagement between lead posters and solution providers. All parties are responsible for conducting their own due diligence.

3. User Accounts

To use certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

4. Lead Posting

Lead posters may publish financial service requirements on the platform for a one-time listing fee of $299 USD per lead. This fee is non-refundable once the lead has been published and made active on the marketplace.

By posting a lead, you represent that the information provided is accurate and that you have a genuine need for the described financial services. Leads that contain false, misleading, or fraudulent information may be removed without refund.

5. Provider Subscriptions

Solution providers may access the full marketplace through a monthly subscription plan:

• Standard Plan — $300/month
• Pro Plan — $400/month

Subscriptions are billed monthly through Stripe. You may cancel your subscription at any time through the billing portal. Cancellation takes effect at the end of the current billing period. No partial refunds are provided for unused portions of a billing cycle.

DealHarbor does not charge success fees or take a percentage of any deals closed between lead posters and providers.

6. Prohibited Conduct

You agree not to engage in any of the following prohibited activities:

• Ghost shopping — Providers are strictly prohibited from posting fake leads to gather competitive intelligence about other providers or the marketplace. Violations will result in immediate account termination without refund.
• Submitting false, misleading, or fraudulent information in leads or proposals.
• Attempting to circumvent the platform to engage directly with parties discovered through DealHarbor without proper engagement.
• Using automated tools, bots, or scrapers to access or collect data from the Service.
• Interfering with or disrupting the integrity or performance of the Service.
• Violating any applicable laws, regulations, or third-party rights.
• Sharing account credentials or allowing unauthorized access to your account.

7. Intellectual Property

The DealHarbor platform, including its design, features, content, and technology, is owned by Faisal Khan LLC and is protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on any part of the Service without our prior written consent.

Content you submit to the platform (lead descriptions, proposals, attachments) remains your property. By posting content, you grant DealHarbor a non-exclusive, worldwide license to display, distribute, and use that content in connection with operating the marketplace.

8. Limitation of Liability

To the maximum extent permitted by law, DealHarbor and Faisal Khan LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, arising out of or in connection with your use of the Service.

Our total liability for any claims arising from or related to the Service shall not exceed the total amount you have paid to DealHarbor in the twelve (12) months preceding the claim.

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

9. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the Service, you consent to the collection and use of information as described in the Privacy Policy.

10. Termination

We reserve the right to suspend or terminate your account and access to the Service at any time, with or without cause, and with or without notice. Grounds for termination include, but are not limited to, violation of these Terms, fraudulent activity, or conduct that we determine to be harmful to other users or the platform.

Upon termination, your right to use the Service ceases immediately. Provisions of these Terms that by their nature should survive termination will remain in effect, including intellectual property, limitation of liability, and governing law sections.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes arising from or related to these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

12. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated through the platform or via email to registered users. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
